1. Introduction
Thank you for choosing MusicDiffusion. Please read this terms bellow carefully as well as the different terms and contracts you must agreed during your registration to our services, our Privacy Policy and Anti-Fraud Policy (collectively named as the “Terms of Service”). These Terms of Service form a legal agreement between you (the « User », « You ») and MusicDiffusion (« MusicDiffusion », « MusicDiffusion.com », the « Company », the « Platform », « Us », « Our », « Service » or « Website »), operated by the company MWM, under the French registration number B 527 824 40. All users of the Website (including, without limitation, you) shall be considered as « Users » hereunder. By using MusicDiffusion.com (including, without limitation, our Music Distribution Services, our Artist Services, our Social Network, our Applications, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, and to comply with all applicable laws and regulations.
The use of the website implies full agreement with the following terms of service. If you do not agree with these terms of service, please refrain from using this website.
2. Website General Terms & Conditions
2.1 Ownership
You may not resell or claim intellectual or exclusive ownership to any of MusicDiffusion services or products, modified or unmodified. All services and products are property of Company. You may not reproduce the Platform, in whole or in part, for any purposes. You may not copy and/or distribute the Platform, in whole or in part, by any manner.
2.2 Services & Products Delivery
After we have successfully received your payment, your service and/or product informations will be emailed to the mail address you provided during your order.
If you do not receive a notification by email after 24h from us, please contact our customer service with the provided contact form or directly via [email protected].
2.3. Warranty
Our services and products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our services or products.
2.4. Prices
Our prices are advertised and listed on our website excluding taxes. Taxes are automatically calculated in our cart and checkout systems based on your situation (country, currency, etc.). Our default currency is EUR but you can choose your preferred currency on our top menu. Additional costs may apply, such as currency conversion fees or setup fees, and these costs will always be fully detailed during checkout before any payment. The company reserves the right to change the prices of its individual services and products at any time without prior notice, without affecting any orders placed before.

At MusicDiffusion, we are committed to delivering efficient and reliable customer support. If you encounter any issues or have questions about your order, please contact our customer service through the provided contact form or directly via [email protected].
When it comes to our Music Distribution services, MusicDiffusion operates as a DIY platform. Our support team remains available via email and provides assistance primarily through documentation and resources available in our Help Center.
Support is provided on a reasonable efforts basis and does not include unlimited, real-time or on-demand assistance.
For security, verification, and data protection reasons, support is only provided to Users contacting us through the email address associated with their account, their order or otherwise verifiable identity. MusicDiffusion reserves the right not to process or respond to requests that cannot be reasonably linked to a valid user account or service.
In order to ensure fair access to support for all users, you agree to use support channels in a reasonable, proportionate and respectful manner.
Excessive, repetitive or abusive use of support channels — including, but not limited to, sending multiple repetitive messages, opening duplicate requests, spamming, or attempting to bypass normal support processes — may result in:
– delayed or deprioritized responses,
– consolidation or closure of duplicate or redundant requests,
– limitation of support to a single communication channel,
– redirection to self-service resources (Help Center),
– or temporary restriction of support access.
Support requests are processed based on priority, complexity, and overall system load. Submitting multiple messages or follow-ups does not accelerate response time and may, in certain cases, result in additional delays.
MusicDiffusion reserves the right to organize, filter, prioritize and manage incoming support requests in order to maintain service quality and operational stability.
In cases of serious or repeated misuse, including disrespectful, aggressive, or disruptive behavior, MusicDiffusion may restrict or limit support interactions to essential communications only, without affecting access to the core service, unless such behavior constitutes a violation of these Terms.
MusicDiffusion enforces a strict policy against harassment and disrespect in interactions with its teams. This includes, but is not limited to, insults, threats, and blackmail. Such behavior may result in:
– restriction of communication to formal or essential channels only,
– limitation of support access,
– suspension of the user account in case of serious violation,
– and, where applicable, legal action.
2.6. Refund Policy
Our services consist of non-tangible digital services that may be delivered and executed immediately after purchase.
By purchasing and using our services, you acknowledge and expressly agree that the execution of the service may begin immediately. Where applicable, and in accordance with European consumer laws, you may waive your right of withdrawal once the service has been fully performed.
Refund requests may be considered within fourteen (14) days of purchase, provided that the service has not been fully delivered or used.
MusicDiffusion reserves the right to refuse refund requests where:
– the service has already been fully executed,
– the User has already benefited from the service,
– or the request is not made in good faith.
Refunds, when granted, may be issued via the original payment method or, where agreed with the User, as a voucher or account credit.
Refund requests related to violations of these Terms (including, but not limited to, copyright infringement or fraudulent activity) will not be considered valid refund requests.

More generally, if you encounter any issue with our services, our support team will make reasonable efforts to assist you and find an appropriate solution.
3. Music Distribution Terms
Our digital music distribution services are governed by a separate agreement (the “Contract”), which must be accepted electronically upon the creation of a distribution account (https://dashboard.musicdiffusion.com). This agreement is accessible at any time in the “Contract” section of your account.
This Distribution Agreement defines and reflect in detail the core terms between you and our external partners, conditions, and obligations related to the use of our distribution services, including our compliance requirements towards third-party partners (such as digital service providers, stores, and social media platforms).
The use of our music distribution services is intended for Users operating in a professional or commercial context, including independent artists, labels, and rights holders managing and exploiting their content.
In addition to the Distribution Agreement, certain operational, financial and compliance-related provisions — including, but not limited to, pricing conditions, royalty payments, and anti-fraud rules — are further specified in these Terms of Service.
3.1 Album Upload & Delivery
When you create a music distribution account, it will be automatically set up with our Standard Plan (Check out our different plans & pricing).
To take advantage of our Free Plan for distributing your music on social media, please complete the album upload and contact our Support Team through our contact form or directly via [email protected]. Don’t forget to provide the link from your dashboard to your album so our support can proceed with the delivery for free.
To access our Platinum Plan (Unlimited), please purchase the option. Once your order has been confirmed, our team will make the necessary adjustments to your music distribution account and notify you by email in best delays when your platinum plan is activated and ready to use. If you don’t receive a confirmation mail, don’t hesitate to contact our support through our contact form or directly via [email protected].
3.2 Duration and Termination
The duration of our contractual relationship is for an indefinite period. It shall begin upon registration to our Music Distribution platform/dashboard.
You or we may terminate the Service at any time, subject to a thirty (30) days’ notice period.
Any request relating to account termination, contractual termination, content removal, or any other sensitive or legally binding action must be submitted in a clear and verifiable manner by the User.
For security, legal, and verification purposes, MusicDiffusion reserves the right to require that such requests be submitted through specific communication channels, including, where deemed necessary, a formal written notice or registered mail sent to the Company’s official address.
MusicDiffusion may also request additional information or documentation in order to verify the identity of the requester and ensure the legitimacy of the request before processing it.
Requests submitted through channels that do not allow reasonable verification of the User’s identity, including the use of an email address not associated with the account, may not be processed.
MusicDiffusion shall not be held responsible for any delay or failure in processing a request where sufficient verification of identity or legitimacy cannot be established.
In order to ensure the security of accounts, and comply with legal and partner obligations, MusicDiffusion reserves the right to refuse, suspend, or delay the processing of any request that is incomplete, unclear, inconsistent, or potentially fraudulent.
Termination or removal requests will only be considered effective once properly received, verified, and confirmed by MusicDiffusion.
3.3 What you can do and what you can’t do
By registering and uploading content on the Company’s music distribution platform, You acknowledge and agree to comply with the following obligations:
You shall use the Platform diligently and only upload information and content for which You own the rights or have obtained all necessary authorizations from the relevant rights holders.
You may only upload content for which You hold full ownership, and must not upload any content whose rights are held by third parties without proper authorization.
MusicDiffusion reserves the right to request any documents, contracts, or certificates necessary to verify your rights to the content.
Where reasonable doubt exists regarding ownership or authorization, MusicDiffusion may refuse, suspend, or remove such content and temporarily suspend any associated royalties, pending verification, investigation, or compliance review, until sufficient proof is provided.
You shall provide accurate, complete, and up-to-date information as required for the proper use of the Service.
You shall not use the Platform for any unlawful activity or any action that may harm, disrupt, or damage any party, including MusicDiffusion or its partners.
You undertake to use the Platform in good faith and agree not to:
– provide false or misleading information regarding your identity;
– create multiple accounts without prior authorization from the Company;
– upload or distribute content without the necessary rights or licenses;
– assign, transfer, sublicense, or otherwise make the Service or your account available to any third party without prior consent;
– engage in fraudulent activities, including but not limited to artificial streaming, bots, or false copyright claims;
– use technical means, including anonymization tools, in a manner intended to conceal identity or engage in fraudulent or abusive conduct.
More generally, any behavior aimed at generating fraudulent or artificial revenues from our partners (including digital stores, social networks, and streaming platforms), as further detailed in Section 3.5 (Anti-Fraud), may result in the suspension or termination of your account.
Where necessary, and particularly in cases of suspected fraud, abuse, or legal risk, such measures may be taken without prior notice, in order to comply with partner requirements and protect the integrity of the service and our relations with our partners, in accordance with Section 3.7 (Blocked Account Policy).
3.4 Content Rights, User Responsibility and Indemnification
A) Grant of Rights
By uploading any content to our services, including our music distribution platform/dashboard, You acknowledge and agree to the following:
You grant MusicDiffusion a non-exclusive, worldwide license to administer, reproduce, distribute, communicate, and otherwise exploit the content uploaded by You (including recordings, videos, compositions, artwork, and related materials), either directly or through third-party partners, on the Digital Music Services selected by You, for the duration of our contractual relationship and in accordance with the applicable Terms, including the collection and processing of revenues generated from such exploitation.
You represent and warrant that You own or control all necessary rights to the content uploaded, or that You have obtained all required authorizations from the relevant rights holders, and that such content does not infringe any copyright or other rights of any third party.
You authorize MusicDiffusion to collect revenues generated from the exploitation of your content on your behalf, including through third-party partners, and to process and distribute such revenues in accordance with these Terms and applicable agreements.
B) User Responsibility
You acknowledge and agree that You remain solely responsible, to the fullest extent permitted by applicable law, for any content uploaded, distributed, or otherwise made available through the Platform.
You represent and warrant that all content provided by You complies with applicable laws and does not infringe any intellectual property rights, contractual rights, or any other rights of third parties.
C) Indemnification
You agree to indemnify, defend, and hold harmless MusicDiffusion, its affiliates, partners, service providers, and employees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
– any breach of these Terms;
– any claim that your content infringes or violates the rights of a third party;
– any fraudulent, misleading, or unlawful activity conducted through your account;
– any failure to obtain the necessary rights, licenses, or authorizations.
D) Role of MusicDiffusion
You acknowledge that MusicDiffusion acts as a technical intermediary facilitating the distribution of content through third-party partners.
Accordingly, MusicDiffusion shall not be held liable, to the extent permitted by applicable law, for:
– the content uploaded by Users;
– the consequences of its distribution;
– or any decisions, actions, or policies of third-party platforms or partners.
E) Rights in Case of Claim or Violation
In the event of a claim, dispute, suspected infringement, or legal action related to your content or activity, MusicDiffusion reserves the right, at its sole discretion and based on objective elements, to take any necessary measures, including:
– suspending or removing the content;
– suspending or withholding any associated royalties;
– placing royalties in escrow pending investigation or resolution;
– providing relevant information to competent authorities or affected third parties where required by law;
– taking any action necessary to protect its legal, financial, or reputational interests.
F) Compliance with Third-Party Requirements
You acknowledge that the distribution of your content is subject to the rules, policies, and requirements of third-party partners (including digital service providers, social networks, and content platforms).
MusicDiffusion reserves the right to enforce such requirements and to take any necessary action to ensure compliance, including content removal, account suspension, or restriction of services.
3.5 Anti-Fraud
Fraud in all its form is wrong and strictly prohibited on MusicDiffusion. In order to keep safe our artists and music labels community, our priority number one is to comply all our partner guidelines and to avoid fraud in all its forms. We work very hard and invest extensive ressources to avoid automated and fraudulent behaviors. For this reason, we created a specific Anti-Fraud Policy, with a strike system that is available on this page. When you accept our Terms of Service, you also acknowledge and accept our Anti-Fraud Policy and, therefore, You accept that, among other commitments, You will not, and will not authorize any third party to, directly or indirectly, generate automated, fraudulent, or otherwise manipulated and invalid playback actions, especially in Digital Music Services.
Particularly, but non-exclusively, we will categorize as Fraud the following activities:
- The unauthorized exploitation of material protected by Copyright (Copyright Infringement). You need to be able, at any time, to fully justify under five (5) days the complete paternity of any material uploaded on our platform (including samples that you may use).
- The infringement of any Law that regulates the ownership of legal right holders.
- The use of (misleading) artist, band or label names or artwork which may create confusion or false expectations related to content which is served to consumers throughout our Service (i.e., Musical Spam and Misleading Content).
- The use of automated digital bots or other means to “click” on payment-generating links pretending to be consumers (i.e., Click Fraud), producing unnatural and fraudulent incomes.
- The upload of distorted music, silenced songs, or with any other deceptive features, also to generate revenues and other unauthorized activities which are in breach with the Terms of Use and/or the agreements we have with our partners.
- The use of suspicious playlists curated and/or owned by you in the sole intention to promote your tracks and generate fraudulent royalties.
- The use of manual or automated resources, bots or any other means with the intention to stream and monetize content in violation with our partners terms and conditions.
- The use of manual or automated resources, bots or any other means to unlawfully monetize content through MusicDiffusion.
You agree that any of these previous infringements can lead to the definitive suspension of your account.

5. Miscellaneous Provisions
(a) MusicDiffusion may at its sole discretion and at any time, modify or interrupt all or part of its Websites and/or Services and/or Applications.
(b) We may amend these Terms of Service, the Anti-Fraud Policy, the Privacy Policy or any other legal document from time to time and without prior notice, in which case the new terms will supersede prior versions.
(c) If any provision of these Terms of Service is found invalid or inapplicable, that provision will be enforced to the maximum extent permissible, and the other provisions will remain in force.
(d) If MusicDiffusion does not avail itself at a given time of provisions of these Terms of Service cannot be interpreted like being worth renunciation to prevail itself later on of the aforesaid conditions.
(e) Confidentiality: any information provided to you (including but not limited to your dashboard, statistics, marketing materials, notifications, mails, support, etc.) is strictly confidential. You agree to treat such informations as confidential and to not utilize, disclose, transmit to third parties or make them public in any way by You without our prior written agreement. You accept that public communication of any materials above, or screenshot from our services that are protected under copyrights law can conduct to the suspension of your account and the termination of our contract without prior notice.
(f) Law and Juridiction: These terms are subject to French laws and Paris courts (France). The language to be used in the arbitral proceedings shall be French. In the event of a dispute in the application of these Terms of Service, the User will first contact MusicDiffusion with a formal notice of dispute to negotiate in good faith and to settle the dispute to mutual satisfaction before the competent courts.
